Abstract
Due to the rapid growth of Artificial Intelligence (“AI”) in recent years, there have been significant discussions and debates on how it will impact various intellectual property laws, including the right of publicity. As AI continues to develop, it has allowed everyday people to use this new form of technology to infringe on others’, specifically celebrities', voices, images, and more, to create their own form of entertainment. This Comment explores the intersection between AI and the right of publicity laws across the country, highlighting the dangers that AI poses on the current state of the right of publicity while urging Congress to enact a federal right of publicity bill. The need for a federal right of publicity law is more prevalent now than it ever has been. With how advanced AI has become, both living and deceased artists and celebrities deserve a medium of protection from this constantly growing technology. A federal bill will ensure that states must change their current right of publicity statutes to encompass the most practical form of protection for their citizens. This Comment argues that as AI continues to advance, legal frameworks need to change and adapt to ensure the protection of individuals' right of publicity in an increasingly digital and AI-driven world.
